Solicitor General Kennedy Ogeto has refuted claims that the court declared the Nairobi Metropolitan Services unlawful.

The Nairobi Metropolitan Services (NMS) has refuted reports that it has been declared unconstitutional by the High Court.

Earlier today, June 11, 2021, news circulated online alleging that the Court had declared the entity as unlawful.

In a statement, Solicitor General Kennedy Ogeto dismissed the allegations as untrue and unfounded. NMS maintained that the entity was constitutionally and legally founded as determined by the court in a ruling on September 17, 2020.

This is after activist Okiya Omtatah had moved to court challenging the legality of the Major General Mohammed Badi-led entity.

Following the petition, High Court judge Hellen Wasilwa on June 18, 2020, ruled that the NMS was an illegal body. She, however, later ruled that it a legal entity.

"The declaration of the illegality of the Nairobi Metropolitan Services as created is now lifted," the ruling read in part.

Ogeto stated that, as the entity's legal counsel, he is not aware of such a declaration by the court.

"In this regard, the NMS remains a lawfully established entity of the National Government, charged with carrying out the legal functions that were transferred by the Nairobi City County Government to the National Government through the deed of transfer signed on the 25th February 2020," Ogeto stated.
