High Court Judge, Justice Alfred Mabeya ruled that the Ksh80 million house be auctioned to recover Ksh4.5 million rent owed in debt.

Kirinyaga Governor Anne Waiguru's Kitisuru mansion is set to be auctioned to settle rent arrears owed to developers of the Kihingo Village home.

High Court Judge, Justice Alfred Mabeya ruled that the Ksh80 million house be auctioned to recover Ksh4.5 million rent owed in debt.

According to court documents, former Tetu Member of Parliament James Gethenji and his brother Gitahi Gethenji, who are directors of Kihingo Village, had paid Ksh4.5 million out of Ksh7 million debt. 


Justice Mabeya ruled that, since Waiguru was yet to complete paying for the mansion, the property was still owned by the Githenji brothers.

He directed Frame Consultants, the developers of the property to attach or auction the house as to retrieve the Ksh4.5 million debt.

"In this regard, Frame Consultants can either attach or auction the property to recover its debt," judge Mabeya ruled.

Waiguru had previously stated that she had an agreement with a local bank to settle the amount through mortgage, but it was established that the agreement did not go through.

According to the developers, the Githenji brothers were yet to settle the arrear, two years after they had reached an agreement.

Frame Consultants petitioned the court to compel kihingo Village to reveal their books and show proof that they would pay the debt, which the Githenji brothers refused.

They, however, told the court that they are expecting Ksh40 million from the Kirinyaga governor which they will use to settle the debt.

Waiguru has been in court battles with the Kihingo Village directors over rent arrears, which saw the brothers seek the court to compel the governor to pay the Ksh40 million.
