Speaking on Tuesday while making submissions at the High Court on a case where Mwilu opposed a petition seeking her removal from office, Senior Assistant DPP Alexander Muteti said the prosecutors are yet to disclose all the allegations against the DCJ.

According to Muteti, once all the evidence is unleashed, the public will be shocked by the magnitude of the allegations against the DCJ.

“The first interested party has not disclosed the entire dossier against the petitioner,” Muteti said.

Meanwhile, while making their submissions during the same case, lawyers representing the Judicial Service Commission; Justice Kanjama and Paul Muite accused DCJ Mwilu of being evasive and failing to respond to allegations levelled against her by the DPP despite being given an opportunity to address them.

“Until today, the petitioner is yet to respond to the substance of allegations against her. What she did instead is file two preliminary objections contending that the matters raised in the petitions were subjudice because they related to a pending appeal. She also claimed that they were a collateral attempt to overturn the decision of the high court,” Kanjama told the court.

At the moment, the DCJ has been accused of abusing her office as a judge of the top court among other charges.
