The court has detained for fourteen days the six police officers arrested over the killing of the two Embu Brothers, Benson Ndwiga (22), and Emmanuel Ndwiga (19). 

The six police officers accused of killing the two brothers were arraigned at the Milimani Law Courts on Tuesday 17 August 2021 before Principal Magistrate Daniel Ndugi. 

The officers accused of the brutal murder are Corporal Consolata Njeri, Corporal Benson Mbuthia, Constable Lilian Cherono, Constable Martin Wanyama, Constable Nicholas Sang, and Constable James Mwaniki.

The prosecution, which is being led by Assistant DPP Jacinta Nyamosi while the LSK represented by Nelson Havi is representing the family of the deceased, said they required at least 14 days to complete investigations before they can face murder charges. 

Their application to have the officers detained for 14 days was granted by Principal Magistrate Ndugi.

The two brothers; Benson Njiru and Emmanuel Mutura were found dead a day after they had been arrested by the police.

An autopsy conducted at the Embu Level 5 Hospital indicated that the two succumbed to head and rib injuries inflicted by a blunt object.

On Monday, August 16, the Director of Public Prosecution (DPP) Noordin Haji ordered the immediate arrest of the six police officers linked to the murders. 

Haji said he had received a preliminary report conducted by the National Police Service (NPS), Internal Affairs unit, from the Inspector General of Police Hillary Mutyambai.

"Based on the Preliminary Investigation Report forwarded by the Inspector General (IG), I am shortly directing the IG to immediately arrest and arraign in court, in Nairobi, all officers involved pending investigations by IPOA to avoid any interference with evidence and or intimidation of witnesses," part of the statement read.
