Havi handed DP Ruto a copy of the memorandum sent to Parliament by LSK in defence of the Constitution.


As Kenya marks 11 years since the promulgation of the Constitution 2010, Law Society of Kenya President Nelson Havi today, August 27, 2021, met with Deputy President William Ruto at his Karen residence.

Havi handed DP Ruto a copy of the memorandum sent to Parliament by LSK in defence of the Constitution.

Citing the case of Christopher Ndarathi Murungaru vs the Kenya Anti-Corruption Commission (KACA) [2006], the LSK president while delivering the memorandum, urged the deputy president to defend, uphold and live by the Constitution.

"My word to the Deputy President on this Katiba Day is mined from Murungaru v KACA [2006] eKLR: “We have said before and we will repeat it. The Kenyan nation has chosen the path of democracy; our Constitution itself talks of what is justifiable in a democratic society," Havi stated.

DP Ruto echoed Havi's sentiments, noting that it is up to each and every Kenyan to defend the Constitution 2010.

"It is our collective responsibility to defend the constitution and the firm foundation of the rule of law by resisting all selfish schemes to mutilate it," the DP stated.

Havi has been a ardent defendant of the Constitution 2010, and led a team from LSK in the petition against the Constitution Amendment Bill 2020.

Following a successful petition, the Building Bridges Initiative (BBI) that proposed multiple changes to the Constitution 2010, was declared unconstitutional and unlawful.

DP Ruto declared the BBI the most dangerous constitutional change in the country's history, citing some of the proposals that were in the bill.
