In his ruling, Judge Hedwig Ong’undi said, “There is no evidence to prove the alerts exist. This court cannot rule on speculation to grant the orders he is seeking.” 

Miguna had earlier stated that Attorney General  Kihara Kariuki and Ministry of Interior CS Fred Matiangi had issued red alerts preventing him from boarding Lufthansa, Air France airlines, and other airlines.

“It is lawful and just that the red alerts issued by the Attorney General and Fred Matiang’i to the two airlines or any other airline be lifted to enable me to travel to Kenya,” he remarked.

In a Facebook post, Miguna had said he would land in Kenya next week on Tuesday. 

“Kenyans, Patriots and Freedom Fighters, My flight is scheduled to land at the JKIA on Tuesday, November 16, 2021 at around 9 a.m. East Africa Standard Time,” Miguna stated.

Miguna left Toronto, Canada, where he was staying after being deported and traveled to Germany for his grand return to the country earlier this week. 

In support of his arrival, the Law Society of Kenya President Nelson Havi remarked that they would travel on Sunday, November 14, to Germany alongside retired Chief Justice Willy Mutunga to meet up with him.

However, Havi acknowledged that they could face resistance but promised to ensure that Miguna arrives in the country.

“There is one thing that Miguna Miguna, Khaminwa, former CJ Mutunga and myself have in common, and that is our unrelenting fight to ensure that there is access to justice, adherence to the rule of law and constitutionalism. If we do nothing about bringing Miguna back home, then we will age with shame,” Havi added.
