The High Court sitting in Nairobi has sentenced Directorate of Criminal Investigations boss, George Kinoti, to a four-month jail term at the Kamiti Maximum Prison.

Kinoti was sentenced after he was found guilty for contempt of court after failing to return firearms confiscated from Jimi Wanjigi.

While delivering his ruling, High Court Judge Antony Mrima noted that DCI kinoti has seven days to present himself to prison authorities.

The court further noted if the DCI boss fails to adhere to the ruling, a warrant of arrest will be issued against him.

“In the event Mr George Kinoti fails to avail himself as order above, a warrant of arrest will be issued against him. The warrant of arrest shall be forthwith executed by the Inspector General of Police.

“In the further event that the Inspector General of Police fails to execute the warrant of arrest, the same shall remain valid and remain executed at any time including when George Kinoti leaves the office of the Director of Public Prosecutions,” Justice Mrima’s ruling read in part.

In January 2019, Justice Mrima directed DCI Kinoti return all firearms and ammunition taken from Wanjigi's residence in 2017.

However, the DCI did not return the guns, prompting Wanjigi to file a contempt of court case against Kinoti and his team.

In his defense, Kinoti argued that he had appealed Justice Mrima’s ruling, adding that some of the guns found in Wanjigi’s possession are not authorised to be held by civilians.

"The firearms were subjected to ballistic examination and a report confirmed the Firearms Act prohibits them," his court papers read in part.

All eyes are now on Kinoti as many await his way forward on the issue.
