Irene Masit is the only IEBC commissioner out of the 'Cherera 4' that has not resigned.

IEBC commissioner Irene Masit's lawyer, Donald Kipkorir, has claimed that his client has been threatened to resign from her position.

Speaking on Friday after he appeared before the tribunal formed to probe Masit and three other commissioners, Kipkorir said that Masit was threatened through a phone call by an identified female caller.

The lawyer further claimed that the investigation by the tribunal may be biased as the other three commissioners had already resigned and the evidence was joined. 

"In view that three commissioners have resigned, to proceed with the investigation as it is may prejudice my client because the documents and evidence is joined," Kipkorir stated.

However, Justice Aggrey Muchelule, the chairperson of the tribunal formed by President William Ruto, said that each commissioner will be investigated individually.

"The commissioners each took the appointment. It was an individual appointment and individual oath taken and it is an individual quest for the removal of the commissioners," Muchelule said.

The IEBC commissioners who have already resigned include IEBC Vice Chairperson Juliana Cherera, Francis Wanderi and Justus Nyang'aya.

On Thursday, lawyer Kipkorir dismissed reports that Masit had resigned maintaining that they had already filed a petition at the High Court in Nairobi to stop her removal from office.

"IEBC Irene Masit has given me firm instructions to quash her unconstitutional impeachment proceedings by Writ of Certiorari. We have already filed a Constitutional Petition in High Court, Nairobi. Any reports that she has resigned are the work of political brokers & idlers," Kipkorir said.
