The graft case was withdrawn under section 87A of the criminal procedure code due to insufficient evidence to sustain the charges.

The Directorate of Public Prosecutions (DPP) has dropped graft charges facing former Transport and Infrastructure Cabinet Secretary Michael Kamau.

The application to withdraw the case was allowed on Tuesday, May 9 by Magistrate Victor Wakhumile.

The DPP withdrew the graft case under section 87A of the criminal procedure code due to insufficient evidence to sustain the charges.

The former CS was being accused of abuse of office and failure to comply with procedures and guidelines relating to the management of public funds.

The particulars of the offenses indicated that Kamau ignored the design of the Kamukuywa-Kaptama-Kapsokwony-Sirisia Road which had been done by Engiconsult Consulting Engineers Limited at the cost of Sh33,303,600 and entering into a Memorandum of Understanding under which the resident engineer redesigned the same road.

The charges saw him being suspended from the Cabinet during retired President Uhuru Kenyatta’s tenure on March 28, 2015.

Kamau however denied the charges and challenged his prosecution all the way to the Supreme Court.

The former CS was in December 2022 appointed by President William Ruto as the Chairperson of the Nation Health and Insurance Fund (NHIF) board for a three-year term.
