A court listening to the probe on the controversial death of Machakos Senator Boniface Kabaka has issued a new directive providing the prosecution with more time to prepare evidential reports needed in the case.
Appearing before senior resident magistrate David Ndungi on Thursday, the prosecution sought more time arguing that reports from the Government Chemist and cybercrime department which are crucial to the case were not ready.
"We are seeking more time to complete all our investigations since a medical report from the hospital has not been furnished to the investigating officer," the prosecution said.
Esther Nthenya Muli; who was arrested in connection to the senator’s illness, but later released on bond, did not oppose the prosecution’s application for more time.

In view of the above, Magistrate Ndungi directed that the case be mentioned on January 28, 2021 to examine whether the prosecution will have received all the required reports.
The directive means that Ms Muli has to wait till the mention date to know whether she’ll be set free or not.
Ms Muli is a person ofinterest in the case as she was with the Senator at an apartment in Kilimani before the latter collapsed and was rushed to Nairobi hospital.
Unfortunately, he succumbed to the illness in early December 2020.
