Senator Orwoba was suspended from Parliament for making unsubstantiated claims about the Clerk, Jeremiah Nyegenye.

Clerk of the Senate Jeremiah Nyegenye has threatened to sue suspended Nominated Senator Gloria Orwoba for defamation.

In a demand letter seen by Nairobi Leo, Nyegenye says the Senator made unsubstantiated remarks touching on his conduct that were defamatory.

The lawmaker first made the claims on August 4, 2023, via WhatsApp status and repeated them on Wednesday, September 20 via a video message.

The claims insinuated that the clerk of the Senate made sexual advances towards her, which she refused claiming that she was victimised because of her stand.

In the demand letter drafted by Wamae & Allen Advocates, the clerk termed the claims as false and defamatory saying they have depicted him as a person who has abused chapter six of the constitution on leadership and integrity.

"The false and erroneous allegations and the innuendos and juxtapositions in your various publications as stated above have portrayed our client as a person who discharges his constitutional duties on the whim based on sexual favours," the demand letter signed by lawyer Allen Gichuhi reads in part.

"Our client has had an illustrious career spanning more than 26 years in public service. Your publication of these allegations on the internet in your WhatsApp status, Facebook and X with links to social media platforms which are easily accessible constitutes very serious libel and defamation of our client and has caused him tremendous embarrassment, mental and psychological anguish and loss of reputation," the demand letter further stated. 

Nyegenye is now demanding the Senator to stop making publication of false and defamatory allegations against him.

He also wants her to immediately remove all the claims from all social media handles where she posted, all internet websites and other publicly accessible forums. 

Nyegenye also wants the Senator to offer an unequivocal public retraction and apology in terms to be approved by him. 

Orwoba was on Wednesday suspended from the chambers and precincts of Parliament for six months for making the allegations and linking some of his colleagues to corruption.

The House upheld by majority vote recommendations of the Powers and Privileges Committee contained in a report tabled on August 10 suspending her until February 2024.

MPs concurred with the report that Orwoba stands guilty as charged since she snubbed an invitation to appear and defend herself before the committee.

"Having accorded Senator Gloria Orwoba an opportunity to be heard, the senator declined to participate in the inquiry by the committee on Powers and Privileges and hence the committee found the charges to stand.

"The committee considered the evidence before it on this charge and given that there was no evidence to the contrary to refute the charge, the charge was therefore confirmed,” the report says.
