The Supreme Court had previously declared CDF illegal and unconstitutional.

The National Treasury will release Sh2 billion for the Constituency Development Fund (CDF) on December 9, 2022.

This follows an advisory by Attorney General Justin Muturi regarding the Supreme Court's ruling that CDF was unconstitutional.

Muturi said that the Supreme Court decision did not affect the current CDF Act.

The Supreme Court had previously ruled that the CDF Act 2003, as amended by the CDF (Amendment) Act, 2013, was unconstitutional on account of procedural lapses in the law-making process.

This comes after Members of Parliament called for the government to release CDF funds as constituencies did not have funds to release as bursaries for school going children.

Last week, National Assembly Majority Leader Kimani Ichung'wah stated that he was afraid of stepping into his office in Kikuyu Constituency as he had no funds for bursaries.

The Kikuyu MP said that claimed that millions of school going children were not sure about reporting to school in January 

"Millions of school going children are not sure whether they will report to school in January because no single constituency has funds to award bursaries. I'm even afraid of stepping into my constituency office in Kikuyu," Ichung'wah stated.

Before leaving office, former Treasury CS Amb. Ukur Yatani maintained that CDF remained illegal and the Treasury was not going to release funds for the same.
