The ODM party through its Matungu parliamentary candidate David Were has petitioned the outcome of the recently conducted poll.

Were has filed a petition at the Kakamega High Court seeking to overturn the election of Peter Nabulindo in the March 2021, by-election.

Through his lawyers; Kenneth Marende and Dr. Ken Nyaundi, Were argued that the election was not conducted in accordance with the set laws.

Having lost with over 4,000 votes, Were notes that corruption and other election malpractices interfered with the authenticity of the poll.


In the petition, Were wants the court to confirm his claims and hold IEBC accountable for the same.

“I pray that it will be declared that Nabulindo was not validly elected as MP. That the non-compliance, irregularities, and improprieties in the by-election were substantial and significant to affect the results thereof.

“I urge the court to grant other orders that seem just and fit pertaining to this case," said the former three-term MP for Matungu in his court papers,” Were’s petition read in part.

According to the results announced by IEBC, Nabulindo emerged victorious with 14,679 votes against Were's 10,500 votes.

Matungu is perceived to be an ANC stronghold, currently, ODM and ANC are not in good terms as the latter has been accusing the former of deceit.
