Ruth Kulundu was accused of arranging an illegal commission plenary meeting for the Cherera four without approval.

The Employment and Labour Relations Court on Thursday, January 26 suspended the interdiction of Independent Electoral and Boundaries Commission (IEBC) Deputy CEO Ruth Kulundu.

In her ruling, Justice Linet Ndolo noted that IEBC CEO Marjan Hussein Marjan violated the IEBC HR policy when issuing an interdiction letter to Kulundu last year.

"It is safe to conclude that the charges were about insubordination and threat to staff…," ruled Justice Ndolo.

IEBC CEO Marjan Hussein Marjan suspended Kulundu from Office on September 2022 on allegations of gross misconduct, insubordination, and participation in illegal activities, contrary to her employment terms of service.

She was also accused of threatening, intimidating IEBC staff, and arranging an illegal commission plenary meeting without approval.

During the meeting, four commissioners who contested the results of the 2022 presidential election chose law firms to represent the commission in the presidential election petition filed by Azimio la Umoja One Kenya Alliance candidate Raila Odinga.

Former IEBC chairman Wafula Chebukati also picked another legal team led by former Attorney General Prof. Githu Muigai forcing the Supreme Court to settle the dispute.
