  • The DPP has filed an application in court seeking to amend the charge sheet of Ex-CS Henry Rotich in the Arror and Kimwarer dams’ case.

The Director of Public Prosecutions has filed an application in court seeking to amend the charge sheet of Ex-CS Henry Rotich in the Arror and Kimwarer dams’ case.

In the application, the DPP wants the court to allow for the consolidation of Rotich’s file with that of former Kerio Valley Development Authority (KVDA) Managing Director David Kimosop.

The application, was, however, opposed by the defense who accused the DPP of delayng the case.

Through lawyer Katwa Kigen, the defense told the court that the charge sheet has been amended severally, adding that it is now time for the case to proceed as it is.

 “This is the fifth time that we are taking plea afresh on 23 July 2019, October 31 2019 and May 11 2021,” Katwa said as quoted by The Star.

Defending the application for amendment of the charge sheet, Special Prosecutor Taib Ali Taib noted that some of the parties involved in the case approached the DPP and sought to have their files reviewed.

 “It was not the DPP who triggered the process, it was the accused who triggered and the DPP responded,” Taib was quoted.

Chief Magistrate Lawrence Mugambi indicated that the matter will be heard on October 26, 2021 and directed the defense to respond to the application within three days. The DPP was also directed to respond the defense’s response within three days.
