  • Havi and Mutunga were meant to travel to Toronto, Canada but have now changed their mind and will be heading to Germany instead.

Law Society of Kenya (LSK) President Nelson Havi has announced that he will be travelling to Germany on Sunday alongside Ex-Chief Justice Willy Mutunga in a bid to bring exiled lawyer Miguna Miguna back home.

According to Havi, they were set to travel directly to Toronto Canada, but changed their itinerary after Miguna left Canada for Germany earlier this week.

Speaking to Nation, Havi said plans are in place to ensure they bring Miguna home safely, adding that a petition has already been filed in court seeking to have red alerts placed against Miguna withdrawn.

Havi acknowledged that they may face resistance from government operatives, but maintained that they will do anything legally possible to ensure the exiled lawyer returns home.

“We know that the path we have taken will be tumultuous but we are doing all that is legally possible to bring Miguna back home. That is why we want this red alert lifted.

“There is one thing that Miguna Miguna, Khaminwa, former CJ Mutunga and myself have in common, and that is our unrelenting fight to ensure that there is access to justice, adherence to the rule of law and constitutionalism. If we do nothing about bringing Miguna back home, then we will age with shame,” he told the local daily.

Miguna was deported from the country in February 2018 after he oversaw the mock swearing-in of ODM leader Raila Odinga as the people’s President.

His previous attempts to return to the country have been countered by the government, with the latest being in 2018 when red alerts were issued against him.

The issuance of red alerts meant that airlines could not be allowed to ferry Miguna into the country, thus making it impossible for him to jet back.

All eyes are now on Havi, Mutunga and Miguna as they are set to make another attempt on November 16, 2021.
