The second petitioner in the presidential petitions, John Njoroge, has requested the court to nullify the presidential election and prohibit IEBC chairman Wafula Chebukati from conducting any further elections.

Through his lawyer Zehrabanu Janmohamed who spoke on Wednesday, August 31, as the hearing of the petitions kicked off, Njoroge also wants Chebukati to be barred from holding any public office.

Senior Counsel Janmohamed said that the sovereign will of the people was not reflected in the election maintaining that an election should be an event where voters know their votes count and not hope that their votes count.

“There is a prayer we have requested for that there should be a nullification of this election. An election is an event. You are going to the ballot, you are going to cast your vote and you’re hoping that your vote counts. We shouldn’t be in a position where we hope that our votes count. We should be in a position where we know our votes count,” Janmohamed stated.

On requesting the court for the prohibition of Chebukati holding a public office, Janmohamed said that the IEBC chair had breached Chapter 6 of the Constitution which talks about leadership and integrity.

“We have also requested that the chairperson (Chebukati) be prohibited from conducting any further elections in view of his behavior and/or holding any public office in Kenya in breach of Chapter 6 of he constitution,” the senior counsel added.
