Justice Monica Mburu on Thursday ruled that the public service commission followed the due process of the law

The employment and labour relations court has dismissed a case filed by the Law Society of Kenya seeking to stop the appointment of a Chief Administrative Secretary. 

Justice Monica Mbaru on Thursday ruled that the public service commission followed the due process of the law in creating and recruiting the intended office holders.

“Employment and Labour Relations court delivers judgment on the CAS case and finds that the PSC followed the correct procedure in setting up the office. The petition by the Law Society of Kenya is dismissed,” read the statement.

The court had earlier put a gag order in the recruitment process until the case was filed before it is heard and determined.

“In the Interim to allow service upon the Respondent an order of stay of implementation of the process of establishment of the office of Chief Administrative Secretary in the Public Service be and is hereby issued,” ruled Justice Mbaru.

The latest ruling is a huge win for Ruto who was keen on rewarding his close allies who stood with him and campaigned for his presidential bid.

The CAS post has been facing legal headwinds so much so that it was at one time declared illegal.

The court ruling now gives Ruto an opportunity to make some appointments in which he will most likely award his loyalists.
