"The media must get it correct because they are saying the court has done Ruto a blow."

Azimio la Umoja leader Raila Odinga on the High Court’s ruling declaring the appointment of Chief Administrative Secretaries (CASs) unconstitutional.

Addressing the media on Tuesday, July 4 at the SKM Command Centre in Karen, Nairobi, Raila welcomed the decision saying the court did the right thing.

The former Prime Minister however urged the media to get it correct and not to report that the courts dealt President William Ruto a blow.

“We think that the court has acted correctly in doing what is right. The media must get it correct because they are saying the court has done Ruto a blow. The court has just upheld the law, what the Constitution says. They have interpreted it correctly,” said Raila.

He added, “This is what we talk about the decision of power and responsibilities, parliament makes laws, the executive implements those laws, and if there is a dispute the courts interpret those laws in terms of the constitution, that is their responsibility so they have done their work properly in our view.”

The High Court on Monday nullified the 50 CASs positions saying the creation of the additional 27 CASs did not adhere to the constitutional requirement of public participation.

The court also stated that the CAS position was abolished last year and the newly created one could no longer benefit from that stay.

“The newly-created office and fresh complement of 50 had to comply with the constitution and the criteria set out earlier in Okiyah’s case in order to be lawfully established. They did not comply. The entire complement of 50 CASs is therefore unconstitutional,” Justice Kimondo ruled.
