The Court of Appeal on Friday lifted the orders suspending the implementation of the Finance Act 2023. 

Wiper Party Leader Kalonzo Musyoka has weighed in on the Court of Appeal’s decision to lift the orders suspending the implementation of the Finance Act 2023.

Speaking on Friday, July 28 during the requiem mass of victims of the anti-government protests at SKM Command Centre in Karen, Kalonzo said Kenyans are now going to be heavily taxed due to the Act.

“We are told that the Court of Appeal has lifted the orders suspending implementation of the infamous Finance Act 2023 and they say pending determination of the main suit. What that means is Kenyans are now going to be even more heavily taxed,” said Kalonzo.

The Court of Appeal in its ruling on Friday stated that the appeal filed by Treasury Cabinet Secretary Njuguna Ndungú over the case had merit.

"The upshot of our decision is that the application has merit and the same is allowed as prayed with the effect that the order made on 10th July 2023 suspending the Finance Act 2023, and the order prohibiting the implementation of the Finance Act 2023, be and is hereby lifted pending the hearing and determination of the appeal. Costs shall abide the outcome of the appeal,” the court ruled.

The decision was made by a three-judge bench; Mohammed Warsame, Kathurima M'inoti, and Hellen Omondo who also said the petition against the Finance Act 2023 will be heard and determined within 60 days.

The Finance Act 2023 was suspended on Friday, June 30 by High Court Justice Mugure Thande.
