Kakamega Senator Boni Khalwale has mocked the Azimio La Umoja coalition after suffering yet another defeat at the Court of Appeal.

This comes after the court of appeal lifted the suspension on the Finance Act 2023, paving the way for its implementation.

The Azimio coalition is among the petitioners who sought to have the Act suspended.

Reacting to the developments, Khalwale insinuated the ruling on the Finance Act 2023 was a testament that the coalition was destined to fail.

"Lost the 2022 General Election, lost the BBI and presidential election petition in the Supreme Court, lost Maandamano in the streets, and finally, lost the Finance Bill in the Court of Appeal. For Azimio, It never rains it pours," he tweeted.

The Court of Appeal on Friday set aside an order suspending the implementation of the Finance Act, 2023.

Justice Mohamed Warsame, Kathurima M'Inoti and Hello Omondi ruled that they were persuaded that the applicants have satisfied the principles for the grant of the orders sought.

The judge added that public interest tilts in favour of setting aside the conservatory orders by the trial Judge.

"The upshot of our decision is that the application has merit and the same is allowed as prayed with the effect that the order made on July 10, 2023, suspending the Finance Act 2023, and the order prohibiting the implementation of the Finance Act 2023, be and is hereby lifted pending the hearing and determination of the appeal," the judges ruled.

Treasury CS Njuguna Ndungu had said the suspension of the Act is affecting government operations.
