“These people should let President William Ruto fulfill his manifesto accordingly or rather give an alternative."

Trans Nzoia Senator Allan Chesang has chided Law Society Of Kenya (LSK) President Eric Theuri over a fresh petition challenging all new taxes in the Finance Act 2023.

Chesang in a statement on Friday, August 4 wondered why LSK moved to court yet there is already a case challenging the Act.

The UDA senator stated that the LSK is late to challenge the Finance Act as it has already been implemented.

“How many times will the Finance Act be litigated? LSK is too late in the day to challenge this Act that has already been implemented. They had the bill & more than a month to prepare the necessary pleadings. Does Theuri wants the Judge to issue another conservatory order or his intention is to take credit from my good friend Okiya Omtatah? ” he posed.

Chesang at the same time asked Theuri to let President William Ruto to fulfill his manifesto or give alternative solutions instead of challenging the Act in court.

“These people should let President William Ruto fulfill his manifesto accordingly or rather give an alternative not just to roam in courts even though it's their right,” he added.

The LSK moved to court through lawyer Noel Ngoloma Okwach to challenge the constitutionality of the whole Act.

The society asked the court to issue orders blocking all new taxes including the Housing Levy arguing that mandatory deduction for affordable housing threatens the social economic interest of Kenyans.

"We are seeking the court to issue orders prohibiting the government from implementation, further enforcing section 10 (2) (3) of the Income Tax Act as amended by Section 7 of the Finance Act 2023," the court documents read in part.

LSK also argued that the Housing Levy will add more burden on employers and employees, a move that will likely lead to unemployment.
