The bipartisan committee had invited Chebukati, Guliye and Molu to make oral submissions on the conduct of the 2022 elections.

Cabinet Secretary for Defence Aden Duale has weighed in on the move by former IEBC chairman Wafula Chebukati and commissioners Abdi Guliye and Boya Molu to refuse to appear before the ongoing bi-partisan talks.

In a statement on his X account on Thursday September28, Duale said Chebukati had fulfilled his constitutional duty on the 2022 general elections.

The Defence CS noted that it is the IEBC that should present a post-election assessment report to the country and parliament.

“Mr Chebakuti has done his constitutional duty on the 2022 Elections and it’s only IEBC to present to the country and Parliament the 2022 Post election Evaluation report as per the law . Period,” Duale stated.

Chebukati in a statement on Thursday said they will not discuss issues that have already been resolved. The former IEBC chairman also noted that appearing before the committee will be a betrayal of the IEBC staff who were tortured and murdered.

“Prof Abdi Guliye Molu Boya & I won’t be appearing before the National Dialogue Committee to discuss issues that have been resolved. To participate would be to betray IEBC staff who were tortured & murdered & a reward for impunity,” said Chebukati.

He called for a commission of inquiry to be set up to investigate the events that took place in Kenya's Bomas on 15 August 2022.

Chebukati added that the commission should also investigate the reasons why some of the commission's staff were abducted, tortured or even killed during the election period.

“The outcome of such an Inquiry will bolster the independence of the Commission (IEBC) and ensure that it maintains the stature contemplated in the Constitution of Kenya,” Chebukati asserted.
