A petitioner has filed a case at the Judicial Service Commission seeking the removal of High Court Judge Anthony Mrima from office.

The petition by Michael Mutembei Kibutha Makarina alleges gross misconduct, incompetence against the judge Mrima in the Jimi Wanjigi case in which the Director of Criminal Investigations (DCI) George Kinoti was sentenced to a four-month jail term.

Kinoti was handed a four-month jail term for not complying with court orders to return Businessman Jimi Wanjigi firearms confiscated at one of his homes in 2017.

He was ordered to present himself at Kamiti Maximum Security Prison to start serving his jail term, to which he did not adhere to the deadline.

"In the event Mr. George Kinoti fails to avail himself as ordered above, a warrant of arrest will be issued against him. The warrant of arrest shall be forthwith executed by the Inspector General of Police.

"In the further event that the Inspector General of Police fails to execute the warrant of arrest, the same shall remain valid and remain executed at any time including when George Kinoti leaves the office of the Director of Public Prosecutions," Justice Mrima's ruling read in part.

However, Kinoti got a reprieve after his affidavit was filed through the State Attorney General Kihara Kariuki to have the ruling appealed got approval by the Court of Appeal.

"THAT I swear this affidavit in support of my application dated 30th November 2021. 5. THAT what is stated herein is true to the best of my knowledge save for the matters deposed to on information sources whereof having been disclosed and matters deponed to on belief whereupon the grounds thereof having been given," Kinoti said in an affidavit.
