The former Treasury Cabinet Secretary was cleared together with eight others. 

Former Treasury Cabinet Secretary Henry Rotich and eight others have been cleared in the Sh 63 billion Arror and Kimwarer dam scandal.

Magistrate Eunice Nyutu while issuing the ruling on Thursday, December 14 said Rotich and the co-accused had no case to answer as no evidence was tabled in court to warrant them being placed on their defense.

"All the accused persons in this case are hereby acquitted under section 210 due to lack of evidence as a result of the reckless dereliction of duty by the prosecution," Nyutu ruled.

She however, blasted the prosecution for failing to lead the graft case. The prosecution only produced eight witnesses out of the forty-nine witnesses they had intended to call.

Rotich was facing a total of nineteen charges including unlawfully executing loan agreements to finance the Arror and Kimwarer dams.

In 2019, the Directorate of Criminal Investigations (DCI) detectives arrested the former CS over embezzlement of funds meant for the two dams.

Addressing the media after being acquitted Rotich said he was happy that the case is finally over after many years.

The former CS mentioned that he would give a more detailed statement on the case in the coming days.

"I think the devil has been ashamed and I believe he will permanently be ashamed for those who schemed this evil work. I will give a more detailed reaction," Rotich stated.
