The levelling of murder charges followed recommendations from the Independent Policing Oversight Authority (IPOA).

IPOA's file submitted to DPP established the officer murdered the two at the club in Nakuru.

Preliminary reports indicated the officer disagreed with one of the waiters over a bill.  The incident attracted uproar with the families of the victims demanding justice.

However, the DPP has vowed to collaborate with IPOA to serve justice.

"The DPP reiterates his endeavor to continue the coordination, cooperation and collaboration with Independent Policing Oversight Authority (IPOA) into the foreseeable future in order to enhance accountability, efficiency and expeditiousness in the prosecution of similar cases within the criminal justice system," DPP wrote.
