The official was suspended in November 2023 by the Head of the Civil Service, Felix Koskei, following a recommendation made by EACC.

The Director of Public Prosecutions (DPP) Renson Ingonga has decided to charge suspended Bomas CEO Peter Gitaa Koria with procurement irregularities amounting to Sh8,587,831.00.

In a statement on Friday, April 26, the office of the Director of Public Prosecutions (ODPP) said the decision follows an investigation by EACC on procurement irregularities and splitting of tenders leading to irregular awards to suppliers in the financial year 2020/2021.

“Mr. Peter Gitaa Koria was found to have engaged in procurement irregularities in the award of the following public tenders: Quotation No.15/Kitchen Items; Quotation No.16/Utensils: Quotation No.17/Kitchen Items; Quotation No.18/Plates and Cups and Quotation No.19/Cutlery and Other Items which were not factored in the Bomas of Kenya's Budget and Procurement Plan FY 2020/2021,” read the statement in part.

DPP Ingonga directed Koria to be charged with willful failure to comply with the law relating to procurement by engaging in a procurement process without an approved budget and willful failure to comply with the law relating to procurement by engaging in a procurement process without an approved procurement plan.

The Bomas CEO will also be charged with willful failure to comply with the law relating to procurement by failing to establish an Ad Hoc Inspection and Acceptance Committee.

“The ODPP remains committed to executing its constitutional mandate in accordance with the rule of law and further, with due regard to the public interest, the administration of justice, and avoidance of abuse of the legal process,” ODPP stated.

Koria was among six senior government officers who were suspended on November 2023 by Head of Public Service Felix Koskei on the recommendation of EACC.

On April 18, the Employment and Labour Relations Court directed the Bomas of Kenya board to 'unconditionally' lift the suspension of Koria from employment and immediately reinstate him, pending the hearing and determination of his petition.
