  • Mr Gitau through his lawyer Lawrence Nyangito had asked the court to sentence Mutua to a civil jail term for contempt of court after he refused to pay the directed amount.

A court has issued a warrant of arrest against Machakos Governor, Dr Alfred Mutua for failing to pay Sh5.5 million to businessman David Gitau.

In court documents seen by Nairobileo.co.ke, the warrant is due to failure by the Machakos County Government to pay the said amount, after encroaching and dumping waste into Gitau's land.

“These are to command you to arrest the said Governor, County Government of Machakos and unless they shall pay to you the sum of Kshs 5,590,443.15," said the Machakos Environment and Lands court Principal Magistrate C.N Ondieki.

The County was listed as the first respondent, Governor Mutua the second and the Attorney General the third respondent.

 The judge asked Machakos OCS to avail Governor Mutua in court as soon as possible.

Governor Mutua had failed to comply with a court order requiring him to pay the businessman Sh5,590,443.15 after waste was dumped on his land, despite a court order stopping the same.

Gitau said he had suffered a huge loss and wanted his land back as clean as it was.
