According to the court prosecutor Lieutenant Colonel Arnet Naija, the captain was charged with obtaining money under false pretences contrary to provisions of Section 313 of the Penal Code.


A Kenya Defence Forces (KDF) captain was on Tuesday, November 16, 2021, arraigned in court at the Langa'ata Barracks over malpractices during the February 2021 nationwide KDF recruitment exercise.

Captain Robert Kipkorir Mutai appeared before Senior Principal Magistrate Boaz Ombewa to face charges of receiving bribes during the exercise.

According to the court prosecutor Lieutenant Colonel Arnet Naija, the captain was charged with obtaining money under false pretences contrary to provisions of Section 313 of the Penal Code.


Mutai was also charged with improper conduct of a serviceman which subverts Section 121 of the Kenya Defence Forces Act, 2012.

Mutai is accused of obtaining Ksh90,000 from one Mahamed Shambaro on February 9, assuring him that he would influence the recruitment of Abdulaziz Barisa Shambaro's into the service.

At the time, Mutai was deployed as the administrative officer at the Garsen recruiting centre in Tana River County.

On another count, he was also accused of allegedly obtaining Ksh210,000 from Sgt. Mwanaisha Abdalla in Marafa, Kilifi county. He had also promised her that he would influence the recruitment of one Suleiman Hare Kaginya into the KDF.

Mutai denied the charges and his case was adjourned until 25th January 2022.
