Chitembwe disagreed with the findings of Justice Mumbi Ngungi-led tribunal that had found his conduct questionable.


Embattled High Court Judge Said Juma Chitembwe has moved to the Supreme Court to challenge the findings of the tribunal that recommended his removal from office. 

President William Ruto on February 7 confirmed receiving the recommendations from the special tribunal, adding that he will comply with the Constitution.  

Chitembwe in court papers seen by Nairobi Leo seeks to have the decision recommending his removal quashed.

“Take notice that he Honourable Justice Said Juma Chitembe, being dissatisfied with the decision/findings of the Tribunal appointed to investigate into his conduct delivered to His Excellency the President on February 7, 2023, intends to appeal to the Supreme Court against the whole decision,"  court papers seen by Nairobi Leo reads in part.

The judge is represented by P.W. Wena and Company Advocates.

Chitembwe disagreed with the findings of Justice Mumbi Ngungi-led tribunal that had found his conduct questionable.

"The tribunal unanimously found that judge Chitembwe breached the Constitution while discharging his duties," Justice Ngugi stated.

Lady Justice Mumbi Ngugi, lawyer James Ochieng' Oduol, Senior Counsel Fred Ojiambo, Labour Relations Court Judge Nzioki wa Makau, and High Court judge Abida Ali Aroni, were among the members of the tribunal.

The tribunal was appointed by Former President Uhuru Kenyatta in May 222 to probe the judge.

Chitembwe was exposed by audio and video recordings released by Former Nairobi Governor Mike Sonko.

The two had met numerous times to discuss a court case when the audio and videos were taken.
