The legislator had been charged with conspiracy to commit subversive activities.


Embakasi East MP Babu Owino has been released on bail. 

The MP was on Friday, July 21  arraigned at Milimani Law Courts where a ruling on bail was issued.

The Judge declined to detain the MP for further days saying the prosecution failed to prove how Babu will interfere with witnesses if released.

He was released on a Sh100,000 bail and an alternative of a Sh200,000 bond.

"A look at the affidavit does not disclose compelling reasons to deny the accused person bond, each of the accused persons is granted a bond of Sh 200,000 with an alternative cash bail of Sh 100,000," Milimani chief magistrate Lukas Onyina ruled.

He was released alongside ardent ODM leader Raila Odinga's supporter Calvin Okoth alias Gaucho. Gaucho was also charged with the same offence as that of Babu.

They allegedly committed the offence on dates between July 7 and 23, 2023 with others not before court within Nairobi City County. 

Others Charged with similar offence are Tom Odondo, Michael Otieno, Pascal Ouma, Kevin Wambo and Willys Owino.

The group was also released on bail.

Babu Owino was arrested on Tuesday evening around 8pm at JKIA while on his way home from Mombasa.

He was held at JKIA Police Station before he was allegedly whisked away to Wanguru Police Station in Mwea, Kirinyaga County.

He was released from the police station on Thursday and brought to Nairobi where he was arraigned more than 24 hours later.

The law requires suspects to be arraigned within 24 hours after being arrested.
